Considering disproportionate burden

An organisation can claim that complying with accessibility regulations would impose a disproportionate burden on them. This requires the organisation to conduct an assessment to understand the extent of this burden. If there is evidence of a burden then it must be explained in the accessibility statement.

If you're exploring this option, consider the following points:

  • the assessment needs to consider the size, resources and nature of the organisation. You will also need to estimate the cost associated with addressing accessibility issues and weigh that against the value to disabled people
  • it must be considered from an organisational not departmental level. Part of an organisation is not able to claim disproportionate burden
  • research has highlighted that this approach is viewed negatively by disabled people. There is some evidence that people are less negative if resources are being invested in replacing the service with something more accessible
